The colors you see on this website are representations of the colors of our furniture materials, finishes and connectors but should not be used to make final buying decisions. We strive to show our colors as accurately as possible, but due to the inconsistencies of computer display monitors, we cannot guarantee they are absolutely correct. Color, texture, and graining variations can occur in natural products like leather, wood and stone. These are not normally considered imperfections. You agree that you cannot dispute the finish, or color or texture or any other physical attribute after taking delivery of a product.

my-leaf's guarantee to you

"my-leaf" guarantees our children's furniture to be free of material failure or defective workmanship for a period of one year after your purchase.  we are confident that our furniture is constructed in a way that exceeds almost all other manufacturers in durability, longevity, quality and craft.

production delay

"my-leaf" makes children's furniture in relatively small batches.  we offer high attention to detail. Every piece that leaves the workshop is stamped with an official number which certifies your chair or table.  While we work ahead of orders we cannot anticipate a rush of orders and so your order may incur some delays.  

product safety

"my-leaf" constructs its furniture in accordance with and exceeds ASTM standards governing the production of children's furniture.  we use sustainably harvested Baltic birch plywood, which is known for its durability and strength.  we coat our furniture with child-safe water-based polyurethane finishes.  we do not work with high formaldehyde glues or particle-based sheet materials or high volatile organic compound finishes commonly used by other furniture manufacturers. our products are meant for children (not adults) and are meant for the limited set of activities that common affordances regarding child's play and use allow.  Misuse of our products will void our warrantee and can cause harm to adults and children alike.

dimensional variation

On products where dimensions are critical, a minimum of 1 1/2 " variation from the standard dimension given in the product specification is allowed.  You are entirely responsible for accurately measuring your precise height needs, which are based not only on standard determinations, but also on the intended product user(s).

we accept payment in the following forms:

Credit card:  Visa, Mastercard, Discover.  We require authorization from the credit card company in the full amount of purchase, shipping and handling. Money Orders, Cashier's Checks, and Personal Checks:  Checks must clear before shipment.  Phone and Showroom purchases.  Cash: For in-person, showroom purchases only.

prices

Prices are subject to change. In the event a product is listed at an incorrect price due to a typographical or any other error on any page on the web-site, brochure, promotional material or any other electronic or hard copy document, "my-leaf" will have the right to refuse, cancel, modify, or take any action it may consider appropriate to address the error for any inquiry, quotation, purchase order or orders placed for products listed at the incorrect price, regardless of whether an order confirmation has been sent or not, and/or any payment has been made or not. If one or more payments have already been made and your order is confirmed, accepted, refused, cancelled, or modified in such a case of incorrect price, "my-leaf"  will refund any payment or payments you have already made for such item or items. Such a Purchase Order or Orders will not be considered confirmed, and the item or items will not be shipped due to the non-validity of the Purchase Order or Orders. In no event shall "my-leaf" be liable to ship the product to the customer at the inaccurate price. While our goal is a 100% error-free Site, such mistakes can happen and we cannot guarantee that any or all content is accurate or complete, including price information, product specifications, lead time, or any other attribute listed on the web site. If we discover such errors, they will be corrected on our system using best efforts on the part of "my-leaf", and the corrected price or other information will be notified to you, and will be applied to your Purchase Order or Orders.

sales tax

In conformance with the laws of the State of New Mexico, shipments to destinations in New Mexico are charged sales tax (gross receipts tax) of 6.875%, based on purchases of merchandise and also shipping and handling.  Those who live in other states/ territories will not be charged sales tax for orders with "my-leaf".  All purchasers should consult applicable tax laws in their state/ territory.

Upon receipt of payment, order confirmation and shipping tracking information will be sent to an electronic or physical address which you provide.

methods and charges

Our products are typically shipped via ground service with small package carriers such as UPS and FedEx.        If you would like to check the status of your shipment please refer to shipping company details and tracking number.  Any change of delivery date, address or telephone number must be received in writing and called in to our delivery department before midnight a week before the specified delivery date. We cannot deliver to APO, FPO, PO Boxes or personal mailboxes. Please use a valid street address for delivery of your order. It is entirely your responsibility that the furniture dimensions allow for easy delivery through doorways, passageways, stairways or any other way as you deem fit, and will fit into the living space of your choice.  All delivery charges are for curbside delivery to your delivery address. You agree to be available to receive the product from the carrier at the time of delivery, and represent that the delivery address provided by you is accessible to commercial trucking and delivery companies. Curbside delivery by definition means the trucking service will park in front of your delivery address and you will need to receive the product from the back of the truck. "my-leaf" assumes no responsibility or liability to damage of the product, personal injury to someone or any other issue that can arise due to getting the product from the curbside to the inside space.

international orders

At this time, , "my-leaf"  cannot ship items outside the 48 contiguous states. We do, however, encourage customers who live outside the continental US (including Hawaii and Alaska, AFO/FPO addresses, Puerto Rico, and Canada) to consult with a freight forwarding company. , "my-leaf"  is happy to ship items to freight forwarding companies within the US that can then ship items to international destinations. Please note that orders sent to freight forwarders must be inspected by the freight forwarder.  "my-leaf"  liability for damages ends once the items have been signed for by the freight forwarder.

shipping taxes

Shipping and handling is charged extra. Please contact "my-leaf" for exact shipping charges to your address. Other items such as customs duty charge, and other fees and taxes may apply for international addresses as well as Hawaii, Alaska, and Puerto Rico.

shipping time

Shipping transit times add one to three weeks to your lead time depending on the item shipping method used and destination.   Items shipped via UPS or FedEx should arrive within 5 to 7 days of the lead time noted on the website.  Shipping time frames reflected in product descriptions are based on estimates. "my-leaf" reserves the right to amend product information and shipping schedules due to manufacturing delays and changing conditions.. In the event of a shipping delay, "my-leaf" will notify you promptly, and cannot be held responsible for shipping delays beyond estimated delivery times.  Under no circumstances will "my-leaf" be responsible for any consequential damages resulting in shipping delays.  Please understand we are doing our best to ensure best deliveries suited for your product.

delivery (how to receive your shipment)

"my-leaf" takes great pride in packaging their furniture.  Unfortunately, pieces are occasionally damaged during transit.  Should this happen during your delivery, here are some helpful suggestions to protect your investment:  Please take the time to read the following important information regarding the delivery of your furniture.  You must be present to receive, inspect and sign for your delivery.  It is important to be as detailed and descriptive as possible on the packing slip before you sign for your items.  A signature indicates acceptance; if you simply sign without inspecting the box or its contents, then you are accepting the shipment “as is.”  We will not be able to file a claim with the shipper on your behalf unless you notate any damages at the time of delivery.  If the box appears to be in good condition, but you cannot inspect the shipment due to time constraints, please note “not inspected at delivery” on the shipping waybill.  However, if the box is compromised in any way, please note “box damaged, possible damage to piece, not inspected at delivery” on the waybill. Any damages must be reported to our customer service department within 5 days of receipt of the item.

If you authorize the product to be delivered in your absence or without your inspection, you automatically represent that the product is received in good condition and will void all rights to returns, claims and insurance. If the damage is severe, you agree to refuse ONLY the item that is damaged and make notations on the freight bill. You are also required to submit digital photographs of damaged material that should be clearly visible in the digital photograph to substantiate the claim within one day of receiving the shipment. In case the damage is noticed after unpacking the goods, you agree to notify both the trucking company as well as "my-leaf"  immediately. We will need some digital photographs clearly indicating the damage. In such an event, the claim will have to be initiated by the consignee – in this case You, the Customer, as a concealed damage. In cases where multiple items are part of an order, the charge-back allowed on your credit card will be limited to the value of the damaged item or items after the above mentioned evidence is submitted and approved. Items received in good condition or without any evidence of damage as stipulated above will be charged as listed above in the payment section. "my-leaf"  CANNOT AND WILL NOT ACCEPT ANY ITEMS RETURNED WITHOUT PRIOR APPROVAL OR AUTHORIZATION; SO, PLEASE DO NOT RETURN ANY OF THE ITEMS WITHOUT PRIOR APPROVAL OR AUTHORIZATION FROM "my-leaf".

returns

All our products are guaranteed by "my-leaf" and insured by the shipping company to arrive in perfect condition. However, purchased items may be returned within one (1) day of receiving shipment. 45% restocking fee will apply and the customer is responsible for the return shipping charges. No refund will be made for purchases until the items have safely arrived to our warehouse. Custom colors and products are not refundable. Customers who wish to return non-damaged items must also pay return shipping fees and restocking fees.

Authorization from "my-leaf" is required prior to the return of any item. We will give you instructions on where and how to ship. We recommend that you insure returned items for the full value of the item shipped. If you`re not satisfied with your purchase, please contact us within one day of purchase to arrange an exchange or refund of your unused Product. Please make sure to keep your receipt and return the Product in its original packaging. As stated previously, "my-leaf" will not assume the transportation charges for any Products returned by any transportation agency or company for products purchased through "my-leaf". If you`re not satisfied with your purchase, please contact us within one day of purchase to arrange an exchange or refund of your unused Product. damage/potential damage:

When a box arrives, whether by UPS, FedEx or Common Carrier (other truck), you are responsible for IMMEDIATELY determining whether the (1) box is damaged or (2) if the product inside is damaged. When you sign for a package without any further WRITTEN comment, you are waiving ALL rights that both you and "my-leaf" have to claim freight damage. Often boxes appear damaged on the outside, but the products, which are carefully packed for shipping by the manufacturers, are fine inside. However, if you see that, and cannot open the box, you must write that down with the delivery person when you sign for that delivery. Sometimes a box is simply left outside on your doorstep. In all cases, open boxes immediately and carefully inspect for damage. If you find damage, notify "my-leaf" immediately by email and follow up by phone. You may have as little as 1 business day to report damage, and begin the process of making a damage claim

cancellations

"my-leaf"  works to ship orders as quickly as possible. For this reason, we cannot guarantee that we will be able to cancel your order after it has been placed. If you need to cancel your order please email us ASAP (within 1 business day of placing your order) at info@my-leaf.com and we will attempt to cancel your order. If your order has already shipped, please see our Returns policy for further instructions.  A minimum of $50.00 will be retained towards transaction charges for all cancellations at any given time. All orders cancelled after 24 hours will be charged 45% towards re-stocking fees.

limitation of liability

In no event will "my-leaf be liable for special, punitive, indirect, incidental, consequential or exemplary damages arising out of this agreement or out of the use of this website or for service provided by "my-leaf", including without limitation, damages or costs relating to the loss of profits, business, goodwill or operation/ inoperation of this website.  In no case shall "my-leaf"'s  liability for money damages exceed the "my-leaf" invoice amount paid by you for the product.  "my-leaf" cannot be held liable for accidents resulting in personal injury that involve a product purchased on the site

guarantee does not cover

Variations in the color or graining of wood, wood products, fabric or other materials, including dye lots; natural markings inherent in the finish of any material.   Damage including scratches, chips, rips, tears and glass or mirror breakage due to normal household use, misuse, abuse or accidents; damage or discoloration caused by sunlight; wear, shading or shrinking of any fabric due to improper cleaning; damage due to moving the furniture from the original delivery location or address.  Commercial usage. Using the furniture for anything but normal household use will void guarantee. Click here for additional conditions of guarantee.   This guarantee applies to the original purchaser only. "my leaf's" liability under this guarantee is limited to repair or replacement of the defective product at its discretion. This guarantee applies under conditions of normal household usage and does not apply to defects resulting from misuse, accidents, negligence or commercial use.  In no event shall "my-leaf" be liable for consequential or incidental damages or breach of this or any other warranty, expressed or implied whatsoever even if the loss or damage is caused by "my-leaf"'s negligence or fault.

All Site Content, in whole or in part, is protected by all applicable copyright laws, international conventions or treaties, and any other intellectual property or proprietary laws, and, unless in the public domain, or unless otherwise stated, is owned by Us, whether or not such rights are expressly identified in, or in connection with, such Site Content.

You understand and agree that You may not remove, alter or cover any copyright or other proprietary notices placed on Our Site. No other license to use any of the Site Content is given or implied without Our prior written consent. Credit card or check information is only shared with financial institutions that process your payment. Shipping information is shared with shippers that fulfill your order.  We do not sell, rent, share, trade or give away any of the information you provide to us except to the financial institutions processing your payment or your financing application and the shippers that produce and/or deliver your order. No third party will solicit you as a result of information within our control.  It is true that the information you provide is subject to disclosure pursuant to judicial or other government subpoenas, warrants, or orders. miscellaneous terms

This Agreement constitutes the entire agreement between You and Us, and supersedes any prior agreements between You and Us. If any provision under this Agreement is held by a court of competent jurisdiction to be invalid or unenforceable for any reason, the remaining provisions will continue in full force without being impaired or invalidated in any way. Our failure to exercise or enforce any right or provision of this Agreement will not constitute a waiver of such right or provision.
